The Commercial Payments Bill and the Future of Retentions
The Commercial Payments Bill (Bill) was introduced to Parliament on 19 May 2026 and is now making its way through the legislative process. The Bill introduces three key sets of reforms: a prohibition on retentions in construction contracts, measures to improve payment practice, and stronger enforcement powers for the Small Business Commissioner (SBC). No official announcement has been made about when the Bill is likely to come into force however, we expect Royal Assent during 2027.
